Terms of Service

By accessing or using Apex Portfolio (the "Service"), you agree to be bound by these Terms of Service. If you do not agree to all of these terms, do not use the Service. We reserve the right to modify these terms at any time, and we will provide notice of such changes by updating the "Last Updated" date above. Your continued use of the Service after changes constitute your acceptance of the new terms.

Apex Portfolio provides a proprietary "Career Engine" designed to help users document their professional experience, build living portfolios, and generate tailored career documents (Resumes, Cover Letters, etc.).

To access certain features, you must create an account. You represent and warrant that all information provided is accurate and that you are responsible for maintaining the security of your account and password. We reserve the right to suspend or terminate accounts that violate these terms or engage in abusive behavior.

You retain all ownership rights in and to the content you upload, submit, or create within Apex Portfolio ("User Content").

By providing User Content, you grant Apex Portfolio a worldwide, non-exclusive, royalty-free license to store, process, transform, and display your content solely for the purpose of providing the service (e.g., generating your portfolio site or AI-optimized resumes).

• AI Processing: You explicitly allow automated processing and transformation of your content to enable AI features like the "Document Studio" and "Persona Lenses."
• No Selling of Data: We do not—and will not—sell your personal career data or User Content to third parties for advertising or marketing purposes.

You agree not to use the Service for any illegal activity or to violate any laws in your jurisdiction. Prohibited activities include, but are not limited to:

• Scraping other users' data
• Impersonating any person or entity
• Attempting to breach security measures
• Spamming or spreading malware

Subscriptions are billed in advance on a recurring, periodic basis (the "Billing Cycle"). Monthly or annual cycles are available. We reserve the right to change our pricing with at least 30 days' notice. Refunds are handled on a case-by-case basis unless otherwise required by law.

Aside from User Content, the Service and its original content, features, and functionality are and will remain the exclusive property of Adam Jones/Apex Portfolio. Our trademarks and branding may not be used without prior written permission.

The service is provided on an "AS IS" and "AS AVAILABLE" basis. To the maximum extent permitted by law, Adam Jones/Apex Portfolio shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the service.

These Terms shall be governed and construed in accordance with the laws of the **State of Florida, United States**, without regard to its conflict of law provisions.
